LEGAL ASPECTS OF ELECTRONIC BUSINESS

Code: TOIK2106

Credit Units: 5 cr

Level: Graduate

Aim: Introduce comprehensively the different legal aspects of electronic business.

Content: The legal problems of the electronic commerce: 1) Electronic contracts in consumer trade and in business-to-business trade, 2) questions regarding the intellectual property rights, such as protection of copyright of digital products and protection of trademarks, brands, commercial names and domain names , 3) the protection of the consumer rights, 4) the protection of personal data, 5) liabilities, 6) the taxation of the electronic commerce and 7) the rules concerning the choice of applicable law.

Teaching: Lectures 20 h. It is possible to participate an on-line course. Course will be arranged in a Moodle-environment. Course consists of virtual lectures, discussions and written assignments (essays).

The assessment of the on-line course:
1. Active participation in on-line discussion and on-line questionaire.
2. Questionaire (10 questions covering different aspects of the course). Written answers (1 page /question) on the questions provided by the teacher. The answers must be based on the course literature.
3. Two written essays (5–10 pages / essay) about the key issues of the course. Students are obliged to comment and discuss each other's essays.

Aim: To elucidate how the rules of Intellectual Property Law promote and limit
production and marketing.

Content: Copyright, Right to Patents, Integrated Circuits, Firm and Trademark Law.
Selected parts of Model Law, Plant Breeding Law, Unfair Competition and Business
Secrets. The legal protection for digital products is especially emphasized.

Market law & Intellectual property law:

The examination may be done by a) performing the exam, including the literature and
the questions dealt with on the lectures, or b) answering specific questions and writing
essays, 3 x 5-10 pages + cover page + list of content + list of sources. At least 5
sources per essay. Pay attention to the references. The essays should be done
according to the directives by the faculty. The themes for the essays can be chosen by
the students themselves and a proposal ought to be done by e-mail to the lecturer in
charge. The themes can be chosen from different questions dealt with within the
course. It is recommendable that EU –law, laws, decrees, decision of the Council of
Ministres, decisions from the Supreme Court and the Supreme Administrative Court
etc are used. These can be found on Internet and they are legal sources. Thereto
doctoral theses and the course literature may be useful sources. Useful links are :

The main objective of the Certificates is giving to jurists and graduates in Business Administration and Engineering the necessary tools to know how to solve concrete juridical problems, related with the use of the information and communication technologies in a specialized environment of professional performance, in a context characterized by the globalization of the social relationships.
The Certificates will be granted by the University of Zaragoza to those registered students that pass the required studies. The recognition of the studies carried out in other Universities will be included in the certificate.
The modules will be offered in English or other languages. The teachers will be part of the University of Zaragoza and the Universities and institutions integrated in the LEFIS Network.
It will be required to obtain 30 ECTS to get the LEFIS Specialization Certificate in this form:
- 16 ECTS will be obtained by the carrying out of modules of the corresponding specialization (1 compulsory and 2 optional)
- 14 ECTS will be obtained by the carrying out of other activities and a final report:
. The participation in a Seminar will allow obtaining 4 ECTS
. The realization of the final exam will allow obtaining 3 ECTS
. The elaboration of the final report will allow obtaining 7 ECTS

The main objective of the Master is giving to jurists and graduates in Business Administration and Engineering, the necessary tools to know how to solve juridical problems, related with the use of the information and communication technologies in a specialized environment of professional performance, in a context characterized by the globalization of the social relationships. The Master is an own title of the University of Zaragoza.
The Master will be granted by the University of Zaragoza to those registered students that pass the required studies. The recognition of the studies carried out in other Universities will be included in the title.
The modules will be taught in Spanish, English or other languages. The teachers will be part of the University of Zaragoza, and the Universities and institutions integrated in the LEFIS Network.
The obtaining of 60 ECTS credits will be required to get the LEFIS Master title.
The offer of 60 ECTS will be in this way:
-Three 6 ECTS modules on:
I. Computers, Mobile phones and Internet
II. Juridical documents and standards
III. Law and governance


- The Master Thesis: 12 ECTS

The rest of the credits (up to 30) will have an optional character. They will be get by the carrying out of other tasks in form of:
- Seminars
- Elaboration of reports under teachers supervision
- Evaluation activities
It will also be possible to obtain 3 credits by means of the carrying out of practical stays in institutions, juridical offices or companies.
The University of Zaragoza will give the possibility to get the title of Master with the carrying out of the Spanish studies that the University offers
